Appeal Dismissed in Absence of Final Judgment

In Bagley v. Moeller, No. 2060249 (Ala. Civ. App. August 3, 2007), the Court of Civil Appeals reiterated the rule that, “an appellate court does not have jurisdiction to hear an appeal unless the trial court has entered a final judgment.” A judgment is not final unless the trial court has completely adjudicated “all matters in controversy between the litigants.”  The trial court order denying plaintiff’s motion for default judgment did not constitute a final judgment.
